1. Introduction

We understand that you care about your personal privacy, and we take that seriously. This Privacy Policy describes how Kompozition collects, uses, stores, and shares your personal information, and sets out your privacy rights.

We will update this Privacy Policy from time to time as our practices evolve. When we make changes, we will update the effective date at the top of this page.

2. How We Collect Your Personal Information

Kompozition collects personal information about website visitors, prospects, and customers. This information is generally limited to:

  • Name
  • Job title
  • Employer name
  • Work address
  • Work email address
  • Work phone number

We collect this information when you:

  • Fill out a form or make an enquiry on our website
  • Sign up for or use our services
  • Correspond with us by email or other means
  • Attend an event or webinar we host or participate in

From time to time, we may also receive personal information about you from third parties, such as LinkedIn or other professional platforms, or from our business partners. This information is used only in a manner consistent with this policy.

We only collect personal information that is reasonably necessary for one or more of our functions or activities as described in this policy.

3. How We Use Your Personal Information

We use the personal information we collect to:

  • Provide, operate, and improve our software and services
  • Respond to enquiries and provide customer support
  • Send relevant product, service, and event communications (see Section 4 for your opt-out rights)
  • Manage our business relationship with you and your organisation
  • Meet our legal and compliance obligations

We do not sell your personal information to anyone.

4. Direct Marketing and Your Opt-Out Right

We may use your personal information to send you information about our products, services, and events that we believe may be of interest to you.

You have the right to opt out of receiving direct marketing communications from us at any time. To opt out, you can:

  • Click the unsubscribe link included in any marketing email we send you, or
  • Contact us directly at hello@kompozition.com with a request to be removed from marketing communications

We will action your opt-out request promptly and at no cost to you. Opting out of marketing communications will not affect our ability to send you service-related communications that are necessary for the delivery of our services.

5. Use of the kompozition.com Website

Like most websites, kompozition.com automatically collects certain information when you visit and stores it in server log files. This may include:

  • IP addresses
  • General geographic location based on IP address
  • Browser type and operating system
  • Pages viewed and time spent on pages
  • Referring URLs

We use this information to understand how visitors use our website, to improve its design and content, and to diagnose technical issues. This is a legitimate interest of Kompozition as a business.

7. When and How We Share Information with Third Parties

  • With service providers and sub-processors who assist us in delivering our services (see Section 8 below)

  • To enforce agreements we have with you or to protect the rights, property, or safety of Kompozition, our staff, or others
  • In connection with a business sale, merger, or acquisition, where personal data may be transferred as part of that transaction
  • With your consent, or at your direction

We do not disclose your personal information to third parties for their own independent marketing or commercial purposes.

Before disclosing personal information to any third party located outside the country in which it was collected, we take reasonable steps to ensure that the recipient provides an equivalent level of privacy protection, including through contractual arrangements that impose appropriate privacy and security obligations.

8. Third-Party Sub-Processors

Kompozition uses third-party service providers to assist in delivering our services, including for cloud infrastructure and data storage, customer relationship management, project management, productivity and collaboration, cybersecurity, and AI-powered features. These organisations are bound by contractual obligations to protect your data and may only use it for the purposes we specify.

9. International Data Transfers

Kompozition is headquartered in Canberra, Australia. Your personal information may be stored and processed in Australia and/or the United States, depending on which of our systems and sub-processors are involved in a given activity.

Where personal data is transferred across borders, we take reasonable steps to ensure it receives an equivalent level of protection through contractual arrangements with our service providers and other appropriate safeguards.

We do not currently store personal data on infrastructure located in the European Union or United Kingdom. However, where we process personal data of individuals located in the EEA or UK, we rely on appropriate safeguards such as standard contractual clauses to govern those transfers.

10. Your Privacy Rights (Australia)

Under the Australian Privacy Act 1988, you have the right to:

  • Access the personal information we hold about you
  • Request that we correct inaccurate, incomplete, or out-of-date personal information
  • Opt out of direct marketing communications (see Section 4)
  • Make a complaint if you believe we have mishandled your personal information

To exercise any of these rights, please contact us at hello@kompozition.com. We will respond within 30 days. Where access cannot be provided within that timeframe, we will notify you and provide a revised date. If we are unable to grant access, we will explain why in writing.

There is no charge for making a reasonable access or correction request.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

11. Your Privacy Rights (United States – CCPA/CPRA)

If you are a resident of California or another US state with applicable privacy legislation, you may have the following rights in relation to your personal information:

  • Right to Know: the right to request information about the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for which it is used, and the categories of third parties with whom it is shared.
  • Right to Delete: the right to request that we delete personal information we have collected from you, subject to certain exceptions.
  • Right to Correct: the right to request that we correct inaccurate personal information we hold about you.
  • Right to Opt-Out of Sale or Sharing: the right to opt out of the sale or sharing of your personal information (see Section 12).
  • Right to Limit Use of Sensitive Personal Information: where we collect sensitive personal information, you may have the right to limit its use to purposes permitted by law.
  • Right to Non-Discrimination: we will not discriminate against you for exercising any of your privacy rights. This means we will not deny you services, charge you different prices, or provide a different quality of service because you exercised a right under applicable privacy law.

To submit a request to exercise any of these rights, please contact us at hello@kompozition.com. We will acknowledge your request within 10 business days and respond within 45 days. If we require additional time (up to 90 days total), we will notify you of the extension and the reason for it.

You may also designate an authorised agent to submit requests on your behalf. Authorised agents must provide written authorisation from you or a valid power of attorney. We may contact you directly to verify the authorised agent's identity and the validity of the request.

We will verify your identity before processing any request. Verification may involve confirming information already on file with us.

12. Do Not Sell or Share My Personal Information

Kompozition does not sell your personal information to third parties, and does not share your personal information for the purpose of cross-context behavioural advertising.

If our practices change in the future, we will update this policy and provide you with appropriate notice and opt-out mechanisms before doing so.

13. Data Accuracy

We take reasonable steps to ensure that the personal information we hold about you is accurate, up-to-date, complete, and relevant for the purposes for which it is used.

If you believe any personal information we hold about you is inaccurate or out of date, please contact us at hello@kompozition.com and we will take reasonable steps to correct it promptly.

14. Security of Your Information

Kompozition takes the security of your personal information seriously. We implement appropriate technical and organisational measures to protect your data against unauthorised access, disclosure, alteration, or destruction.

While we take reasonable steps to protect your information, no method of transmission over the internet or electronic storage is completely secure. If you have concerns about the security of your data, please contact us at hello@kompozition.com.

15. Data Breach Notification

In the event of a data breach that is likely to result in serious harm to any individual whose personal information is involved, Kompozition will comply with its notification obligations under the Australian Privacy Act 1988 Notifiable Data Breaches (NDB) scheme. This includes notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.

Where a breach also affects individuals in the United States, we will comply with applicable US state data breach notification laws, which may require us to notify affected individuals and relevant regulatory authorities within specified timeframes.

16. Data Storage and Retention

Personal information collected by Kompozition is stored on our systems and on the systems of our cloud-based service providers, located in Australia and/or the United States.

We retain personal data for as long as is necessary to fulfil the purposes described in this policy, including for the duration of our business relationship with you and for a reasonable period afterwards to meet legal, compliance, and archiving obligations.

Prospect and marketing data is retained until it no longer has business relevance and is then deleted from our systems.

You may request deletion of your personal data at any time by contacting us at hello@kompozition.com, subject to any legal obligations that require us to retain certain information.

17. Children's Data

Our services are not directed at children. We do not knowingly collect personal information from individuals under the age of 18. If you believe we have inadvertently collected such information, please contact us at hello@kompozition.com and we will take steps to delete it promptly.
